Um die Plattform nutzen zu k\u00f6nnen, m\u00fcssen sich Trainer-Nutzer registrieren und dabei wahrheitsgem\u00e4\u00dfe, vollst\u00e4ndige und aktuelle Angaben machen, einschlie\u00dflich beruflicher Daten und Rechnungsdaten.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">4.2. Die Trainer-Nutzer erkl\u00e4ren, dass sie \u00fcber 18 Jahre alt und gesch\u00e4ftsf\u00e4hig sind.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">4.3. Jeder Trainer-Nutzer ist allein verantwortlich f\u00fcr die Aufbewahrung seiner Zugangsdaten und f\u00fcr alle Aktivit\u00e4ten, die \u00fcber sein Konto durchgef\u00fchrt werden.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">4.4. W\u00e4hrend der Testphase ist keine Zahlungsmethode erforderlich und Sie haben vollen Zugriff auf alle Funktionen, einschlie\u00dflich der personalisierten Website und der \u00dcbungsbibliothek.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">5.3. Nach Ablauf der Probezeit (15. Tag):<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">a) Wenn der Trainer-Nutzer keine g\u00fcltige Zahlungsmethode angibt, ist der Zugriff auf die Grundfunktionen beschr\u00e4nkt.<br \/>b) Wenn der Trainer-Nutzer eine g\u00fcltige Zahlungsmethode angibt, beginnt der erste Zahlungszyklus.<\/p><h4 id=\"6-suscripcin-y-facturacin\" class=\"mb-2 mt-4 [.has-inline-images_&amp;]:clear-end font-sans visRefresh2026AnswerSerif:font-editorial font-semimedium visRefresh2026Fonts:font-bold text-base visRefresh2026Fonts:text-lg first:mt-0 md:text-lg [hr+&amp;]:mt-4\">6. ABONNEMENT UND RECHNUNGSSTELLUNG<\/h4><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">6.1. Automatische Verl\u00e4ngerung: Das Abonnement verl\u00e4ngert sich automatisch alle 30 Tage, bis es vom Trainer-Nutzer ausdr\u00fccklich gek\u00fcndigt wird.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">6.2. Beginn der Abrechnung: Der erste Abrechnungszyklus beginnt ausschlie\u00dflich nach Ablauf der Probezeit und wenn der Trainer-Nutzer zum ersten Mal eine g\u00fcltige Zahlungsmethode angibt.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">6.3. Berechnung der Geb\u00fchr: Die Geb\u00fchr f\u00fcr jeden Abrechnungszeitraum wird nach folgender Methode berechnet:<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2 translation-block\">a) Es gilt der Grundpreis f\u00fcr den vom Trainer-Nutzer vertraglich vereinbarten Tarif, der eine bestimmte Anzahl aktiver Kunden umfasst, wie auf der Preisseite von LIFEMOON angegeben. <br>b) Es wird die maximale Anzahl aktiver Kunden berechnet, die w\u00e4hrend des Abrechnungszeitraums erreicht wurde. <br>c) F\u00fcr jeden aktiven Kunden, der \u00fcber die im Grundpreis enthaltene Anzahl von Kunden hinausgeht (zus\u00e4tzliche Kunden), wird der entsprechende Betrag pro zus\u00e4tzlichem Kunden gem\u00e4\u00df dem vereinbarten Tarif berechnet. <br>d) Der Gesamtbetrag f\u00fcr den Abrechnungszeitraum entspricht dem Grundpreis zuz\u00fcglich der Kosten f\u00fcr die identifizierten zus\u00e4tzlichen Kunden.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">6.4. Steuern: Die Preise enthalten keine Mehrwertsteuer. F\u00fcr Kunden aus der EU wird die Mehrwertsteuer gem\u00e4\u00df den OSS-Vorschriften berechnet, f\u00fcr Kunden au\u00dferhalb der EU gilt eine Befreiung.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">6.5. Zahlungsmethode: Alle Zahlungen erfolgen \u00fcber Stripe. Bei abgelehnten Zahlungen unternimmt LIFEMOON bis zu drei weitere Zahlungsversuche. Bei anhaltender Nichtzahlung wird der Zugang zu den kostenpflichtigen Funktionen vor\u00fcbergehend gesperrt.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">6.6. Neustart der Berechnung: Zu Beginn jedes neuen Abrechnungszyklus wird die Berechnung der maximalen Anzahl aktiver Kunden vollst\u00e4ndig zur\u00fcckgesetzt.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">6.7. Integriertes Zahlungsmodul: LIFEMOON bietet ein optionales Stripe-Zahlungsmodul an, mit dem Trainer-Nutzer ihre Endkunden direkt abrechnen k\u00f6nnen. LIFEMOON erhebt eine Verwaltungsgeb\u00fchr f\u00fcr die abgewickelten Transaktionen. Stripe wendet seine Standardgeb\u00fchren an. LIFEMOON ist nicht an der Vertragsbeziehung zwischen Trainer-Nutzer und Endkunde beteiligt. Die Trainer-Nutzer stellen LIFEMOON von Anspr\u00fcchen aus diesen Zahlungen frei.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">6.8. Akzeptanz der Stripe-Bedingungen: Die Aktivierung einer Stripe-Zahlung setzt die Akzeptanz der f\u00fcr die jeweilige Gerichtsbarkeit geltenden Stripe-Gesch\u00e4ftsbedingungen voraus.<\/p><h4 id=\"7-cancelacin-de-suscripcin\" class=\"mb-2 mt-4 [.has-inline-images_&amp;]:clear-end font-sans visRefresh2026AnswerSerif:font-editorial font-semimedium visRefresh2026Fonts:font-bold text-base visRefresh2026Fonts:text-lg first:mt-0 md:text-lg [hr+&amp;]:mt-4\">7. Trainer-Nutzer k\u00f6nnen ihr Abonnement jederzeit \u00fcber ihr Kontrollpanel k\u00fcndigen.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">7.2. Die K\u00fcndigung wird zum Ende des laufenden Abrechnungszyklus wirksam. W\u00e4hrend des restlichen Zyklus beh\u00e4lt der Trainer-Nutzer uneingeschr\u00e4nkten Zugriff.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">7.3. Es werden keine R\u00fcckerstattungen f\u00fcr den laufenden Abrechnungszeitraum gew\u00e4hrt, auch wenn der Trainer-Nutzer die Plattform vor Ablauf des Abrechnungszeitraums nicht mehr nutzt.<\/p><h4 id=\"8-obligaciones-y-prohibiciones\" class=\"mb-2 mt-4 [.has-inline-images_&amp;]:clear-end font-sans visRefresh2026AnswerSerif:font-editorial font-semimedium visRefresh2026Fonts:font-bold text-base visRefresh2026Fonts:text-lg first:mt-0 md:text-lg [hr+&amp;]:mt-4\">8. VERPFLICHTUNGEN UND VERBOTE<\/h4><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">8.1. Die Trainer-Nutzer verpflichten sich zu Folgendem:<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2 translation-block\">a) Die Plattform ausschlie\u00dflich f\u00fcr legitime Zwecke ihrer beruflichen T\u00e4tigkeit zu nutzen.<br>b) Die geltenden Datenschutzbestimmungen in Bezug auf ihre Endkunden einzuhalten.<br>c) Die erforderlichen Einwilligungen f\u00fcr die Verarbeitung der Gesundheitsdaten ihrer Endkunden einzuholen.<br>d) Ihre Mitarbeiter angemessen zu beaufsichtigen.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">8.2. Mitarbeiter: Trainer-Nutzer k\u00f6nnen Mitarbeiter einladen, die unter ihrer alleinigen Aufsicht arbeiten. LIFEMOON verwaltet keine Arbeits- oder Wirtschaftsbeziehungen zwischen Trainer-Nutzern und Mitarbeitern. Der Trainer-Nutzer ist gegen\u00fcber seinen Mitarbeitern zu 100 % verantwortlich.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">8.3. Folgendes ist strengstens untersagt:<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2 translation-block\">a) Reverse Engineering, Dekompilierung oder sonstige Aktivit\u00e4ten, die die geistigen Eigentumsrechte von LIFEMOON verletzen.<br>b) Einstellen illegaler, diskriminierender, gewaltt\u00e4tiger oder betr\u00fcgerischer Inhalte.<br>c) Versenden unaufgeforderter Nachrichten (Spam).<br>d) Beeintr\u00e4chtigung der technischen Funktionsweise der Plattform.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">8.4. LIFEMOON kann den Zugang zu jedem Konto, das gegen diese Verpflichtungen verst\u00f6\u00dft, vor\u00fcbergehend sperren.<\/p><h4 id=\"9-responsabilidad-limitada\" class=\"mb-2 mt-4 [.has-inline-images_&amp;]:clear-end font-sans visRefresh2026AnswerSerif:font-editorial font-semimedium visRefresh2026Fonts:font-bold text-base visRefresh2026Fonts:text-lg first:mt-0 md:text-lg [hr+&amp;]:mt-4\">9. Die Gesamthaftung von LIFEMOON gegen\u00fcber einem Trainer-Nutzer \u00fcbersteigt nicht den Gesamtbetrag, den dieser Nutzer in den letzten 12 Monaten gezahlt hat.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">9.2. LIFEMOON haftet nicht f\u00fcr:<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2 translation-block\">a) Ergebnisse der von den Trainern erbrachten Trainings- oder Ern\u00e4hrungsdienstleistungen.<br>b) Vertragsbeziehungen zwischen Trainern und Endkunden.<br>c) Beziehungen zwischen Trainern und Mitarbeitern.<br>d) Entgangener Gewinn, Datenverlust, indirekte oder Folgesch\u00e4den. <br>e) Anspr\u00fcche Dritter, die sich aus der Nutzung der Plattform ergeben.<br>f) Vor\u00fcbergehende Unterbrechungen aufgrund von Wartungsarbeiten oder h\u00f6herer Gewalt.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">9.3. Die Trainer-Nutzer halten LIFEMOON schadlos gegen\u00fcber jeglichen Anspr\u00fcchen von Endkunden, Mitarbeitern oder Dritten, die sich aus der Nutzung der Plattform ergeben.<\/p><h4 id=\"10-proteccin-de-datos-personales\" class=\"mb-2 mt-4 [.has-inline-images_&amp;]:clear-end font-sans visRefresh2026AnswerSerif:font-editorial font-semimedium visRefresh2026Fonts:font-bold text-base visRefresh2026Fonts:text-lg first:mt-0 md:text-lg [hr+&amp;]:mt-4\">10. Die Trainer-Nutzer behalten die Rechte an den f\u00fcr ihre Endkunden erstellten Trainingspl\u00e4nen, Routinen und Nachrichten.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">11.3.
