1. IDENTIFICATION OF THE SERVICE PROVIDER

These Terms and Conditions of Use (hereinafter, the ‘Legal Notice’) govern access to and use of the LIFEMOON website and mobile application (hereinafter, the ‘Platform’), owned by LIFEMOON OÜ, a company incorporated under the laws of the Republic of Estonia, with VAT number 16945760, VAT number EE102725623 and registered office at Harju maakond, Tallinn, Lõõtsa tn 5, 11415 Estonia.

Accessing and/or using the Platform confers the status of User and implies express and unconditional acceptance of this Legal Notice, which supplements the specific Terms and Conditions for Trainer Users. Contact: contacto@lifemoon.io.

2. PURPOSE AND SCOPE

2.1. This Legal Notice regulates the general use of the Platform by visitors and Users, including access to Content (texts, graphics, videos, exercise and food databases).

2.2. LIFEMOON provides information technology services through the Platform, without assuming responsibility for decisions based on its Content, which is merely indicative and may not reflect the most recent legislative or jurisprudential status.

2.3. This Legal Notice does not regulate the contractual relationship between LIFEMOON and Trainer Users, which is governed exclusively by the specific Terms and Conditions. LIFEMOON may temporarily suspend access for maintenance, with advance notice when possible.

3. DEFINITIONS

For the purposes of this Legal Notice, the following definitions shall apply:

• User: Any person who accesses the Platform.

• Contents: Texts, graphics, designs, photographs, videos, databases and other materials accessible on the Platform, owned by LIFEMOON or authorised third parties.

• Platform: LIFEMOON website and mobile application.

4. REGISTRATION AND CONDITIONS OF ACCESS

4.1. Access to the Platform does not require registration for visitors, but the use of advanced features (such as for Trainer Users) does require registration, in accordance with the specific Terms and Conditions.

4.2. LIFEMOON reserves the right to deny or suspend access for non-compliance with this Legal Notice or illegal activities.

5. AUTHORISED USE AND PROHIBITIONS

5.1. The User undertakes to use the Platform and Content diligently and lawfully, exclusively for legitimate purposes.

5.2. The following are prohibited, including but not limited to:
a) Illegal activities, contrary to good faith, public order or applicable regulations.
b) Damage to physical/logical systems belonging to LIFEMOON, suppliers or third parties; introduction of viruses.
c) Unauthorised access/manipulation of data belonging to LIFEMOON, third parties or Users.
d) Reproduction, distribution, transformation or public communication of Content without authorisation.
e) Deletion/manipulation of intellectual property identifiers or protection mechanisms.
f) Sending unsolicited communications (spam) or technical interference.

5.3. LIFEMOON may investigate, report and collaborate with authorities in the event of infringements, temporarily suspending access without prior notice if necessary. LIFEMOON is not liable for misuse of Content by the User.

6. INTELLECTUAL PROPERTY

6.1. LIFEMOON retains all intellectual and industrial property rights over the Platform, Content (including exercise library, videos, and databases), design, and associated elements, or has authorisation from third parties.

6.2. A limited, non-exclusive, non-transferable licence is granted for temporary use and viewing on personal devices. Any unauthorised use is prohibited.

6.3. The legitimacy of rights over Content uploaded by Users is the sole responsibility of the Users, who shall indemnify LIFEMOON for any third-party claims. Trainer Users retain rights over their plans and routines, in accordance with the Terms and Conditions (section 11).

7. LIMITED LIABILITY

7.1. LIFEMOON takes reasonable technical measures to ensure the proper functioning of the Platform, but does not guarantee:
a) The continuity/total availability of Content/Services.
b) The absence of errors, viruses or harmful components.
c) Accuracy, completeness or timeliness of informational Content.
d) Damage due to security breaches or external links (not controlled or approved by LIFEMOON).

7.2. LIFEMOON is not liable for indirect damages, loss of profits, loss of data or relationships between Users and third parties, limiting its liability to the amount paid in the last 12 months (in line with Terms and Conditions, section 9).

8. PROTECTION OF PERSONAL DATA

8.1. LIFEMOON acts as the data controller for User data in accordance with its Privacy Policy. For data belonging to End Customers of Trainer Users, the Data Processing Agreement applies (in accordance with Terms and Conditions, section 10).

9. DURATION AND MODIFICATION

9.1. Valid indefinitely, LIFEMOON may modify this Legal Notice by giving 30 days' notice by email or Platform (in accordance with Terms and Conditions, section 12).

9.2. Continued use after modifications implies acceptance. The conditions published at the time of access are valid. LIFEMOON may delete/add Content/Services without prior notice.

10. APPLICABLE LAW AND JURISDICTION

10.1. They are governed by the laws of the Republic of Estonia.

10.2. For disputes, submission to the courts of Harju Maakohus (Tallinn, Estonia), in accordance with the Terms and Conditions (section 13). EU ODR platform: ec.europa.eu/odr.
